Louisiana judge refuses bond for Rümeysa Öztürk as Vermont judge reviews jurisdiction

Federal immigration judge denies bond to Tufts graduate student Rümeysa Öztürk, citing flight risk and danger to community. The decision was based on a memorandum from the Department of Homeland Security related to an op-ed co-authored by Öztürk. Her lawyers argue she is being unlawfully detained in retaliation for her views expressed in the op-ed. Öztürk’s counsel is pushing for her transfer to Vermont for medical reasons and to receive independent assistance.

In a hearing in Vermont, lawyers debated the release of Öztürk before a federal judge. The Justice Department argued that Vermont does not have jurisdiction over federal immigration law. Öztürk was detained in March and moved without notice to her legal counsel, who filed a petition in Massachusetts. She is currently detained in Louisiana.

The Justice Department contends that Öztürk must seek release through immigration removal proceedings and that habeas relief is not available in immigration contexts. However, Öztürk’s lawyers argue that her habeas petition does not interfere with removal proceedings and highlight violations of her First and Fifth Amendment rights. The ACLU attorney representing Öztürk emphasized the hearing’s focus on the constitutionality of her detention and arrest.

The case has sparked debate over the authority of the Board of Immigration Appeals and the constitutionality of Öztürk’s detainment. The outcome of the legal battle remains uncertain as Öztürk continues to fight for her release from detention in Louisiana.
