Judicial Ruling Delays Tufts PhD Student’s Transfer from Immigration Detention

The transfer of Rümeysa Öztürk, a Tufts University PhD student from Turkey, from an immigration detention facility in Louisiana to Vermont has been postponed until at least May 6, following a recent judicial ruling. Öztürk was apprehended by masked ICE agents last month while walking in Somerville. After being taken to various locations, she is currently held at the South Louisiana ICE Processing Center, an all-women facility.

Originally in the U.S. on a student visa, Öztürk’s visa was revoked without her knowledge during the Trump administration, resulting in her detention without any criminal charges against her. Her arrest is believed to be linked to her pro-Palestinian views expressed in a campus newspaper op-ed, prompting accusations of discrimination against the previous administration for "judge shopping" in immigration matters.

A federal judge in Vermont previously ordered her transfer back to the state by May 1 to continue legal proceedings, urging for an expeditious resolution. However, the U.S. Court of Appeals for the Second Circuit granted the government an administrative stay, thereby delaying her transfer until a three-judge panel can review the case on May 6.

Court officials have emphasized the need for a prompt decision while ensuring that both parties will have the opportunity for oral arguments. The federal appeals court governing Vermont has a more progressive reputation compared to its Louisiana counterparts, which might influence the outcome of this high-profile immigration case.
