Montgomery, AL – Alabama Attorney General Steve Marshall has taken a stand against Vermont’s controversial Climate Superfund Act, joining 24 other state attorneys general in a legal battle. This lawsuit challenges Vermont officials over legislation that critics claim could devastate American businesses, particularly traditional energy producers, leading to job losses and skyrocketing energy prices.

Marshall condemned the act as an overreach, asserting that it allows a single state to set energy policy for the entire nation. “Vermont’s law threatens to drive up energy prices for Americans and could force producers to cease operations,” Marshall stated. He emphasized that Congress, not Vermont, holds the authority to establish consistent national standards.

The lawsuit, specifically targeting Secretary of the Vermont Agency of Natural Resources Julie Moore and Director Jane Lazorchak, claims the new law imposes retroactive penalties on coal, oil, and natural gas suppliers based on their greenhouse gas emissions from 1995 to 2024. The potential fines, which could reach billions, have alarmed many in the energy sector, who argue this legislation undermines the stability of domestic energy production.

Marshall’s statement called Vermont’s actions "unlawful and misguided," noting the state’s historic reliance on energy resources. He asserted the importance of ensuring affordable, reliable energy for all Americans and vowed to challenge ideological barriers to that goal.

The coalition of attorneys general is seeking an injunction to declare the Climate Superfund Act unconstitutional and preempted by federal law, aiming to protect the interests of American energy producers and consumers alike.
