Judge Halts Trump’s Push to Downsize the Federal Government


A federal judge in California, Susan Illston, has temporarily blocked plans for significant workforce reductions and restructuring across 21 federal departments and agencies, marking a notable hurdle for the Trump administration’s downsizing efforts. Illston’s ruling emphasizes that while the President has the authority to initiate changes within executive branch agencies, such actions must be lawful and typically require cooperation from Congress. The judge indicated that the President likely needs to request Congressional support for the extensive reorganizations he proposes, leading to a two-week temporary restraining order halting these initiatives, including the “Department of Government Efficiency” Workforce Optimization Initiative.

Illston, appointed by President Bill Clinton, expressed her belief that neither the Office of Personnel Management (OPM), Office of Management and Budget (OMB), nor the Department of Government Efficiency (DOGE) possess the legal authority to mandate large-scale terminations or restructuring of federal agencies. This decision impacts numerous departments, including HUD, Interior, and Transportation, where reductions have already affected thousands of employees since Trump took office.

The Trump administration contended that the lawsuit, filed on April 28, was untimely because the relevant Executive Order had been issued nearly three months prior. However, Judge Illston countered, stating that the plaintiffs had taken reasonable time to assess the potential harm caused by the order and related memos.

A coalition of non-profits, unions, and local governments welcomed the court’s decision, arguing that the administration’s chaotic reorganization efforts disrupt essential services. Further arguments in the case are scheduled for May 22, with the White House yet to respond to requests for comment on the ruling.
