Supreme Court Upholds DC Ban on Large Capacity Magazines


On Friday, the Supreme Court upheld a longstanding gun restriction in Washington, D.C., which prohibits magazines holding more than 10 rounds of ammunition. The court, despite its conservative 6-3 majority that typically favors gun rights, opted to avoid taking on new gun rights cases, including a challenge to similar laws in Rhode Island and Maryland. The latter state’s ban on assault-style weapons, including the AR-15, also remains in effect.

The Supreme Court previously expanded gun rights in a notable 2022 ruling affirming that the Second Amendment protects the right to bear arms outside the home. However, since then, it has frustrated gun rights advocates by not addressing cases that could further extend these rights. Washington, D.C., has long been a critical venue for legal battles over gun control, stemming from a landmark 2008 Supreme Court decision that established an individual right to bear arms for self-defense in the home.

In the latest legal challenge, four gun owners argued against the D.C. law on large-capacity magazines, claiming it was unlawful based on the 2022 ruling. Both a federal judge and the District of Columbia Circuit Court upheld the law, with the appeals court concluding that while large-capacity magazines are considered “arms” under the Second Amendment and commonly used, they are subject to regulation due to their potential danger.

Additionally, the Supreme Court declined to hear a significant election case regarding mail-in ballots in Pennsylvania, preserving a ruling that allows voters with defective mail-in ballots to file in-person votes. This decision reflected ongoing disputes between the Republican and Democratic parties regarding election procedures for the upcoming 2024 elections.
